Hearing On The Issue Of Dissolution Of Parliament
January 13 – Debate has started in the Constitutional Court on the writ filed against the dissolution of the House of Representatives. Sapna Malla Pradhan has been added after Judge Harikrishna Karki announced that he will not sit in the bench. Malla, Vishwambhar Prasad Shrestha, Anil Kumar Sinha and Tej Bahadur KC are now in the bench headed by Justice Cholendra Shamsher Jabra. Now a debate has started as to why this issue is in the plenary session. Thirteen writ petitioners have filed a written petition demanding to take the issue to the plenary session. Today, Wednesday, 5 people will debate. An hour is allotted for debate. On behalf of the government, Attorney General Agni Kharel disagreed in the plenary session. Advocate Raman Kumar Shrestha said that the writ was not just a matter of constitutional interpretation. He said, “It should also be decided whether it is a political issue as stated by the Prime Minister in his written reply.” He also mentioned the issue of dissolving the parliament in 2052 BS and 2059 BS in his written reply, so the constitutions of 2047 BS and 2072 BS should also be compared. Therefore, it cannot be obtained from the Constitutional Court. ‘ Advocate Hari Upreti said that it was not agreed to send him to the Constitutional Court earlier. He said, “Since this is a serious matter, we should look at it from a session with a larger jurisdiction than a constitutional session with limited jurisdiction.”
